OSHA vaccination mandate: NDA ‘monitoring developments’

The US National Demolition Association (NDA) said it is “monitoring ongoing legal developments” with the Occupational Safety and Health Administration (OSHA) Covid-19 vaccination and testing mandate for private employers.

The NDA statement comes after a Fifth Circuit judged put on hold OSHA’s ETS (Emergency Temporary Standard) following legal petitions from several states and advocacy groups.

Requiring employers with workforces of 100 or more to ensure employees are fully vaccinated or tested weekly against Covid-19, the ETS was issued last week with a date of 4 January 2022 for it to come into effect fully.

However, the US Court of Appeals said it was placing the ETS on temporary hold due to “[potential] grave statutory and constitutional issues”.

With the situation in terms of a permanent injunction still uncertain, the NDA said: “At this time, it remains unclear how any legal action will impact the future of the ETS, so our members should continue to follow all guidance issued by OSHA on the ETS.

“We are closely monitoring the status of the ETS and will be sure to keep members updated on the latest developments.”
